ShopEarl Restricted Parts Policy

 

This Restricted Parts Policy (“Restricted Parts Policy”) governs the sale and purchase of restricted automotive parts through ShopEarl. Any capitalized terms not defined in this Policy are defined in our Terms of Service (available at shopearl.com/terms-of-service) (the "Terms of Service"). By using ShopEarl to purchase or sell restricted parts, you acknowledge and agree to abide by the terms of this Policy. If you do not agree with these terms, you should refrain from purchasing or selling restricted parts on ShopEarl.

 

Restricted Part Types

 

The following policy applies specifically to restricted automotive parts including airbags, seat belts, batteries, and other safety-critical components that require special handling and regulatory compliance.

 

  1. Safety Concerns. Restricted parts may contain explosive charges and pose risks if mishandled. Restricted parts may be unreliable due to prior damage, improper repair, or degradation. Improper installation can lead to malfunction or injury.

 

  1. Regulatory Requirements. Restricted parts are often classified as hazardous materials (HazMat) by the DOT. Shipping requires specific handling, packaging, labeling, and authorized carriers. Sellers must comply with DOT HazMat regulations.

 

  1. Guidelines and Best Practices for Sellers. Vendors selling Restricted Part Types on our platform must adhere to the following guidelines:

 

  1. ARA Overview. The Automotive Recyclers Association (ARA) promotes responsible practices in the auto recycling industry.

  3. ARA Certification. Sellers may need ARA Certified Auto Recycler (CAR) certification to sell restricted parts, demonstrating adherence to safety and environmental standards.

  5. Handling and Storing. The ARA provides guidelines for safe handling, dismantling, inspection, and storage of restricted parts.

  7. Recall Procedures. ARA-certified sellers must have strict recall procedures, including VIN checks, inventory management, and proper disposal of restricted part types.

 

  1. Buyer and Seller Responsibilities. Both Buyers and Vendors have specific responsibilities when dealing with Restricted Part Types:

 

  1. Fitment Compatibility. Sellers must provide accurate vehicle information (year, make, model, trim), including the VIN, for the source vehicle that the used part is removed from. Buyers are responsible for verifying that a part fits their vehicle.

  3. Product Recalls. Sellers must certify that restricted parts are not subject to recall at the time of sale.

  5. Installation Guidelines. Restricted parts must be installed by a qualified installer, in accordance with the vehicle manufacturer's specifications and any federal, state, or local regulations. Any restricted part that is not installed correctly will subject passengers in a vehicle to risks of serious injuries, including death, which may arise as a result of the improper installation.

  7. Hazmat Shipping. Sellers must comply with all DOT Hazardous Materials Regulations. This includes proper packaging, labeling, documentation, and authorized carriers. Personnel handling shipments must have HazMat training.

 

  1. Returns and Cancellations. All sales of restricted parts are final. No returns or refunds are accepted after shipment. Cancellations may be considered before shipment.

 

  1. Policy Changes. This Restricted Parts Policy may be updated from time to time. The updates take effect immediately upon their posting to the Service. Please review this policy frequently to stay informed about any changes.
